We (“ABShrms”, “we”, “our”) operate www.abshrms.com, providing HRMS software‑as‑a‑service (SaaS), performance management tools, payroll, and related services.

1.2 Acceptance

By accessing or using our site and services, you agree to be bound by these Terms. Use indicates acceptance—even if you have not signed anything digitally.

1.3 Services & Access

We grant you a limited, non‑exclusive license to use the platform and services for your organization subject to payment and compliance with these Terms.

1.4 User Obligations

You must provide accurate registration details, maintain account credentials, and comply with applicable laws. You may not sublicense, resell, or share access with unauthorized third parties.

1.5 Intellectual Property

All content, branding, code, documentation, and software remain our property or licensed to us. You may not copy, modify, or reverse engineer.

1.6 Payment & Fees

Fees are charged via the pricing plans on the website. You agree to pay them when due. Late or non‑payment may result in suspension or termination.

1.7 Termination

We may suspend or terminate your account for non‑payment, breach of Terms, or wrongdoing. Upon termination, access will cease and data retention rules apply as noted below.

1.8 Liability Limitations

To the fullest extent permitted:

  • We aren’t liable for indirect, consequential or punitive damages.
  • Our total liability (whether contract or tort) is limited to the amount you paid in the 12 months preceding any claim.

1.9 Governing Law & Jurisdiction

These Terms are governed by laws of Tamil Nadu, India. Disputes will be subject to courts in Chennai.

1.10 Changes to Terms

We may revise these Terms at any time; updated versions take effect upon posting. Continued use signifies acceptance.

Cookies Policy

1.1 What Are Cookies?

Cookies are small files stored on your device to help our website recognize you and improve usability.

1.2 Types Used:

Data Protection Addendum (DPA)

This DPA governs processing of Personal Data when you (the “Customer”) use ABShrms services.

1.1 Data Controller vs Processor:

You are the Controller for your own personnel data; we act as Processor under applicable data protection law (e.g., India’s PDP Act or GDPR if applicable).

1.2 Purpose & Scope:

Processing is limited to delivering HRMS, payroll, performance, and training services as outlined in the agreement.

1.3 Security Measures:

We implement administrative, technical, and physical safeguards to protect data from unauthorized access, disclosure, alteration, or destruction.

1.4 Sub-processors:

We may engage trusted sub-processors (e.g. payment gateways or hosting providers). We remain responsible for their compliance.

1.5 Data Subject Rights:

You must inform us promptly if data subjects exercise rights (access, rectification, erasure, etc.). We assist as required.

1.6 Retention & Deletion:

Upon termination or request, we will delete or return all personal data within 30 days, unless retention is required by law or contract.

1.7 Breach Notification:

We will notify you without undue delay (and within applicable legal time limits) of any data breach affecting your data.

1.8 Compliance Audits:

Subject to obligations of confidentiality, we allow you to audit our data-processing practices, or rely on independent reports (e.g. SOC 2 / ISO 27001) where available.

1.9 Changes & Updates:

We may update this addendum; material changes will be communicated and come into effect per your agreement.

Refund Policy

At ABShrms®, we strive to ensure customer satisfaction across all our service verticals, including software subscriptions, recruitment, consulting, and training. This Refund Policy outlines the terms and conditions under which refunds may be granted.

1. SaaS Subscription Services

SaaS products offered by ABShrms (HRMS, payroll management, performance tracking, compliance modules, etc.) are billed on a subscription basis (monthly/annually).

  • No refunds will be issued for partial usage or unused periods after activation.
  • Clients are responsible for cancelling recurring subscriptions at least 7 days before the renewal date.
  • Free trials, if applicable, allow testing before committing. Paid subscriptions post-trial are non-refundable.
Example: If a customer purchases a 12-month plan and discontinues after 2 months, no refund will be processed.

2. Recruitment Services

ABShrms provides recruitment support and staffing solutions on a project or retainer basis.

  • No refunds are applicable once a candidate has been placed and the invoice is raised.
  • In the event of a candidate leaving within the agreed replacement period (as per contract), a free replacement will be provided.
  • If no candidate is placed within the agreed timeframe and there is no client-side delay, a partial refund may be considered at management discretion after deducting effort-based charges.

3. HR Consulting & Compliance Services

These include HR audits, policy drafting, payroll setup, compliance filings, and advisory services.

  • Once a consulting engagement is confirmed, refunds are not permitted for work already initiated or delivered.
  • For advance payments made where no services have commenced, a refund may be requested within 3 working days of payment.
  • All refunds, if approved, will be subject to administrative charges and applicable taxes.

4. Training Fees (Classroom & Distance Learning Programs)

Refunds for training programs—both in-person and online—are subject to the following terms:

  • Full refund (excluding payment gateway charges and GST) if cancellation is requested at least 15 calendar days before the course start date.
  • No refund is applicable within 15 days of the start date or after the training has begun.
  • If a participant fails to attend without prior notice, the fee is forfeited.
  • Transfers to a future batch may be permitted once, subject to availability and prior approval.

5. Refund Process & Timelines

  • All refund requests must be submitted in writing to support@abshrms.com along with payment proof and justification.
  • Approved refunds will be processed to the original payment method within 10–15 business days.
  • All refunds are subject to deduction of administrative costspayment gateway fees, and statutory taxes where applicable.

6. Exceptions

No refunds will be entertained in the following situations:

  • Breach of terms by the client
  • Change in internal business strategy after project or subscription confirmation
  • Non-utilization of booked services
